Federal Judge Considers Jurisdiction in Case of Detained Tufts University Student
U.S. District Judge William Sessions in Vermont is currently determining if he has jurisdiction over the case of Rumeysa Ozturk, a Turkish doctoral student from Tufts University who was detained by immigration officials in Louisiana. Ozturk was taken into custody as she walked in Somerville, Massachusetts, and was eventually transferred to an ICE detention center in Louisiana.
Ozturk’s lawyers are challenging the legal authority for her detention and are requesting her immediate release or to be returned to Vermont for further proceedings. The Justice Department argues that the immigration court has jurisdiction over her case, while Ozturk’s legal team is advocating for her release or to be allowed bond during her immigration proceedings.
Judge Sessions suggested the possibility of holding a hearing in his court in May to address Ozturk’s petition if he assumes jurisdiction. Ozturk is among several university students facing visa issues after being accused of attending demonstrations or expressing support for Palestinians. Her detention is being challenged on constitutional grounds, including violations of free speech and due process.
Despite allegations from the Department of Homeland Security that Ozturk engaged in activities supporting a terrorist organization, a State Department memorandum found no evidence of antisemitic activities or support for terrorists in Ozturk’s case. Ozturk’s lawyers are requesting access to this memorandum for further clarification.
The case highlights ongoing challenges faced by international students, especially those involved in activism or expressing political views. The legal proceedings will continue as Ozturk’s lawyers seek justice for their client.
