Karen Read is seeking to dismiss murder charge before retrial, claiming ‘extraordinary’ misconduct.

Karen Read, a Massachusetts woman accused of fatally running over her police officer boyfriend, is set to return to court for a retrial on charges of second-degree murder and other crimes. Her defense team has been pushing for the case to be thrown out, alleging misconduct by law enforcement and arguing that retrying the charges amounts to double jeopardy. They claim that evidence was altered or withheld, including a crucial piece of security video showing the condition of Read’s SUV’s tail light. Prosecutors assert that the tail light was damaged during the incident, but Read’s lawyers argue that the damage occurred after the vehicle was taken into custody. The defense also sought to have charges dismissed based on jurors’ statements that they would have acquitted Read, but the judge denied the request, stating that a verdict was never reached in open court. The defense contends that the judge did not poll the jury to confirm this, and their request for further inquiry was rebuffed. The judge overseeing the case said he would consider the defense’s arguments. Read’s retrial is scheduled to start on April 1st.
