Vermont and other states file lawsuit to prevent Trump’s decision to eliminate birthright citizenship


Vermont Attorney General Charity Clark has joined forces with prosecutors from 19 other states and cities to challenge President Donald Trump’s executive order that aims to end birthright citizenship. The lawsuit, filed in Massachusetts, argues that Trump’s order violates children’s rights under the 14th Amendment to the U.S. Constitution and federal immigration law. The order, signed by Trump and set to take effect in a month, would reinterpret the amendment to exclude children born in the U.S. to parents who are in the country unlawfully or have temporary status.

Clark stated that the executive order is unconstitutional, as babies born in Vermont have a constitutional right to be considered Vermonters and Americans. The lawsuit seeks a preliminary injunction to prevent the order from being implemented, citing previous Supreme Court rulings in favor of birthright citizenship.

In addition to Vermont, 17 states, Washington D.C, and San Francisco have joined the lawsuit against Trump’s order. The executive order is one of many controversial actions taken by Trump at the beginning of his second term, including ending access to the country’s asylum system, withdrawal from the Paris Agreement, and pardoning individuals involved in the January 6, 2021 insurrection at the U.S. Capitol. The lawsuit is just one of the expected legal challenges to Trump’s executive actions.
